Mark description

The mark consists of three-dimensional configuration of product packaging as applied to the exterior of a service truck, including the elements contained on the front, back and both sides of the truck for the applied-for goods and services. The broken lines depicting the truck tires, wheels, door handles, front and rear vehicle lights, grille, license plate, windshield and windows, mirrors, and plastic trim all indicate placement of the mark on the service truck, and are not claimed as part of the mark. The product packaging consists of the following: [1] on the front panel, the words "EXPRESS PLUMBING HEATING & AIR" appear above the windshield in white lettering. Other than the lettering, the front panel is blue. [2] The right-side panel of the service truck has blue extending from the front panel. The blue paint transitions into a wave of water as it extends towards the rear. The water waves crest in two locations, near the front door of the truck and near the rear of the truck. Above the water is a white background. Superimposed over the white background, the words "EXPRESS PLUMBING HEATING & AIR" appear in blue except for the word "HEATING" which is in red. A logo is superimposed over the wave towards the rear end of the van. The logo is a bald man superimposed over circular background. The man is facing away with his head turned to the left and his left arm is extended down his left side with his hand partially clenched. The man is holding a wrench over his right shoulder. The man is wearing a short-sleeved shirt with the letters "EPS" encircled on the back. "ExpressPlumbingIdaho.com" and a space for a telephone number appears at the top of the service truck. [3] The left-side panel of the service truck mirrors the right side, with the exception that the logo remains the same. On the right-side panel the man in the logo is facing towards the rear while on the left-side panel the man is facing towards the front of the truck. [4] The rear panel has blue towards the bottom that extends into a wave that crests on the right side of the rear. Above the blue and the wave is a white background. The same logo described above is superimposed over the cresting wave. A space for a phone number is positioned to the left of the wave. The words "EXPRESS PLUMBING HEATING & AIR" is positioned at the top of the rear panel in blue, with the exception that the word "HEATING" is in red. The words "ExpressPlumbingIdaho.com" in red is positioned below the logo across the rear panel.
