Mark description

The mark consists of an original artwork logo which combines words and design elements. The words "SINCE 1974 MARTINEZ HAND ROLLED CIGARS NEW YORK, NEW YORK" are combined with design elements as follows: A red, horizontal elipse is the central feature of the mark. Circumnambulating the outer edge of the elipse is a golden-orange border, the interior of which border is flush and contiguous with the outer edge of the red elipse throughout its circumference. The outer perimeter of the golden-orange border is scalloped, to give the impression of the sun, or a medallion. The scallops are sixteen in number, and each is divided from the other in equal increments by short red lines, also sixteen in number, that extend from the outer apex of each scallop to the circumference edge of the red elipse which the golden-orange border encloses, suggesting the rays of the sun. The outer edge of each scallop in the border is concave, with its highest point at each apex point of each red line on either side of each scallop, and it's lowest point in the center of each scallop. Inside the red elipse, arranged from top to bottom in four separate lines, are the words "SINCE 1974 MARTINEZ HAND ROLLED CIGARS". The words "SINCE 1974" are printed in white and comprise the topmost line. The word "MARTINEZ" is printed in yellow in old english font and comprises the line second from the top. The words "HAND ROLLED" are printed in white and comprise the line third from the top. The word "CIGARS" is printed in yellow in old english font and comprises the fourth and bottom line. The entire visual effect of these combined literal and design elements are of a shield or medallion, suggesting a sun, or a flower, with the words "SINCE 1974 MARTINEZ HAND ROLLED CIGARS" emblazoned in the center. Centered immediately below this elliptical, escalloped medallion is the image of a thin red ribbon or banner, the main body of which extends the same length of the diameter of the extreme apexes of the medallion, left and right, albeit below, and which appears to be folded at either end, left and right, to extend slightly beyond the extreme length of the medallion image on either side.
