Mark description

The mark consists of product packaging trade dress as applied to a bottle. The bottle has a black wrapped cap bearing the wording "& SONS WILLIAM" in gold script. Superimposed onto the bottom of the black wrapping is a red polygon bearing the number "15" in gold and a design of a stag's head also in gold appears below the "15" and extending onto the neck of the bottle. The wording "VALLEY OF THE DEER" is embossed across the shoulder of the bottle. A gold stag's head appears on the front of the bottle above a chevron design etched into the bottle. Below the chevron is a cream rectangular label bearing wording as follows: "GLENFIDDICH" appears in black, "SINGLE MALT SCOTCH WHISKY 15" appears in gold, "OUR SOLERA FIFTEEN THIS WARM AND SPICY SINGLE MALT IS MATURED FOR 15 YEARS IN BOURBON, NEW OAK AND SHERRY CASKS BEFORE HARMONIZING IN OUR UNIQUE SOLERA VAT appears in small black letters, and "FROM THE VALLEY OF THE DEER" sitting below that appears in gold script. A black band appears at the bottom of the cream label bearing the wording "THE GLENFIDDICH DISTILLERY, DUFFTOWN, BANFFSHIRE, SCOTLAND; HAND BUILT BY WILLIAM GRANT & FAMILY" in very small gold letters. The broken lines depicting the bottle shape indicate placement of the mark on the goods and are not claimed as a feature of the mark. The amber liquid in the bottle is not claimed as a feature of the mark.
