Mark description

The mark consists of two-dimensional portion of trade dress representing the front side of product packaging. Oriented vertically on each side of the trade dress is the stylized wording “BLACK KOW” in the color black, followed by the phrase “FOR BEAUTIFUL FLOWERS,” over the phrase “VEGETABLE GARDENS, SHRUBS & TREES,” which phrases are in yellow and contained within the design of a red ribbon with a black border that has thin yellow lines across the top and bottom of the ribbon. The foregoing wording and phrases are oriented to be read downward on the left side of the trade dress and oriented to be read upward on the right side of the trade dress. In the middle of the top third of the trade dress is the stylized wording “BLACK” above the stylized wording “KOW,” both in the color black. Adjoined to the top left of the letter “B” in the foregoing stylized wording “BLACK” is a black incomplete circular design with a wavy border. Within that is a second incomplete circle with a red border. Within that second incomplete circle is the wording “EST 1969” in the color red, curving across the top inside portion of the circle and separated by the design of two leaves in the color red with yellow veins. Below that design is a red line, and below which is the wording “GREEN” in the color red. Underneath that wording is the wording “SINCE 1969” in the color red, to the left and right of which are two small diamond shapes in the color red. Under the letters “OW” in the foregoing stylized wording “KOW” is the wording “COW MANURE” in the color red, below which is the wording “0.5-0.5-0.5” in the color red, and below that is the wording “ESTIÉRCOL ABONO” in the color red. Below the foregoing series of wording is a depiction of a cow, farm land and farm house, all in the colors black and yellow. Below that depiction is the phrase “FOR BEAUTIFUL FLOWERS,” over the phrase “VEGETABLE GARDENS, SHRUBS & TREES,” which phrases are in yellow and contained within the design of a curving red ribbon with a black border that has thin yellow lines across the top and bottom of the ribbon. Adjoining the bottom of that ribbon, is a rectangular shape with yellow borders on the sides and bottom, the top third of which rectangular shape contains the wording “FEEDS CONTINUOUSLY FOR 3 MONTHS,” below which is the wording “DE HERMOSAS FLORES, HUERTOS, ARBUSTOS Y ÁRBOLES,” and below that is the wording “ALIMENTA CONTINUAMENTE DURANTE 3 MESES,” with all of the foregoing wording being in the color black against a yellow background. Below that, within the same rectangular shape are a series of three depictions combined with wording. Starting at the left, is a depiction of a young plant in the color yellow with black veins, below which is the wording “ALL,” below which is the wording “NATURAL,” below which is the wording “COMPLETAMENTE,” and below which is the wording “NATURAL,” with all of the foregoing being in the color yellow. The trade dress appears on a yellow background. This background is covered by a series of black dots, except such dots do not appear in the top portion of the trade dress and such dots end where the aforementioned black rectangular design begins. The dotted or broken lines depicting the shape of the trade dress indicate placement of the trade dress on the packaging and are not part of the mark. The rectangular shape of the background is not claimed as a feature of the mark.
