Mark description

The mark consists of a three-dimensional configuration of product packaging comprised of a transparent flask shaped glass bottle with a gray metal cap and red and white labels. The bottle includes a short cylindrical neck in the center of the bottle shoulders and has an extruding lip. Below the neck, the bottle is etched with a Talavera inspired design, except for a rectangular area, with rounded corners, on the front and back of the bottle that is smooth for adhesion of the label. The etching on the back of the bottle includes the wording "DE MÉXICO". The gray metal cap is an elongated cylindrical shape with a rounded lip on the bottom, a tapered upper portion, and flat top. The front label is longer vertically corresponding to the shape of the bottle and includes, centered vertically, first wording "GRAN MALO" in large red letters. Directly above the wording, in smaller red lettering, is second wording "EL ÚNICO". Above the second wording is a drawing in red of two figures by a campfire, one figure is a devil and the other figure is a skeleton. The letters "GM" in red appear centered above the campfire and figures. Below the first wording appears two small red glasses half full of liquid. The outer edge of the label includes the following in Latin, "MAGNO MALO, SOLUS TUIS, QUAESUMUS, INFUNDAS MAGIA IN FAUCIBUS LIBERA NOS PERICULIS EXPECTARE NOCTE QUICUMQUE IRE BIBE IUS CUM SALTARE SUB LUMINE DOMINA LUNAM DOMINORUM, ETIAM IN AERI SEQUENTUR ASTRA" in red. The drawing of the two figures is encased by a thin red line with second wording appearing below the horizontal bottom line portion of the encasing thin red line. A second horizontal thin red line separates the second wording from the first wording and a third horizontal thin red line separates the first wording from the two small red glasses of liquid. A thin red line encases the drawing of the two figures, the first wording, the second wording, the two glasses of liquid, and the previously described thin red lines, with the Latin phrase appearing outside this thin red line. The back label is square in shape with rounded corners and includes third wording of "GRAN MALO" in small red letters in the upper left corner. The shape of the bottle and cap are not claimed as a feature of the mark and the broken lines depicting the bottle and cap indicate placement of the mark on the good and are not part of the mark.
