Mark description

The mark consists of three-dimensional trade dress of a portion of the back panel of a display box holding the goods. The claimed portion of the panel extends upwards from the interior back of the box, beginning from just above the tops of the products sitting in the box, and is generally rectangular in shape, but with a cloud design extending above the top edge. The partially cut out cloud design is offset to the left of center and contains the wording "LIT". The background of the panel consists of a diamond pattern, with darker, closely spaced diamonds at the bottom edge of the panel transitioning to lighter, widely spaced, and smaller diamonds toward the top edge of the panel, which fade away entirely by the top quarter of the panel where the cut-out cloud design appears. A partial cloud design appears across the majority of the bottom portion of the panel, oriented to the left the panel's center. Inside the partial cloud design is the wording "LITPIPES.COM" grounded near the bottom edge of the panel. The dotted lines depicting the display box and the products displayed in the box show the orientation of the mark and are not claimed as a feature of the mark.
