Mark description

The mark consists of a three-dimensional trade dress of the product packaging. The entire box is divided into two parts with a thin gray band separating the top from bottom. The thin grey band is horizontal on all sides of the box, except on front of the box where the line dips down in to a "v" shape. The upper arms of the "v" are outlined in gold. The top part of the box, which is about 3/4 of the box, is in shades of dark red. The lower part of the box is in shades of grey and white. The front of the box has: 1) a red white and gold shield surrounded by a large gray and gold outline having scalloped edges placed in the center section of the box. Across the front of the shield are two red and white spears each of which is topped with several red and gold banner flags. At the top of the shield and centered between the spears appears a small grey and red shield bearing a coat of arms featuring a man wearing armor holding a sword and riding a horse. The man, sword and horse appear in the red and grey. Below the shield having the coat of arms appears a red banner outlined in grey, containing the stylized white, word "CHIVAS". Below the red banner is appears a gold generally heart-shaped shield design with an internal cross in saltire. The heart-shaped shield design is outlined in grey. Below the heart-shaped shield is another red banner outlined in white that contains the word "REGAL" flanked by two white lines; and 2) in the lower section of the front box is a thin grey line. The back of the box has: a generally heart-shaped shield design with an internal cross in saltire with the "CHIVAS" and the number "12" in white lettering next to the design, all in white and place near the top part of the red section; 2) in the lower par of the red section is the wording "JAMES & JOHN CHIVAS" in white lettering. On each side of the box there is: 1) the word "CHIVAS" and the number "12" placed vertically in the red section of the box; and 2) in the lower white and grey section of the box are the roman letters "XII" that is created by thin green lines. Top of the box is red and dark with a white generally heart-shaped shield design with an internal cross in saltire. The bottom of the box is in shades of white and grey.
