BAREFOOT BUBBLY

Mark description

The mark consists of a three-dimensional configuration comprising of a trade dress for a bottle. The label consists of a white capsule covering the neck of the bottle that wraps around the bottle; at the base of which is a white neck label that wraps around the bottle, on which appears, diagonal stripes of color in a fixed pattern of purple, blue, green, yellow, orange, red, black, brown, pink, white, and light blue. Scattered around the neck label are gray dots representing bubbles. At the bottom of the neck label is a white medallion with silver around the edge. Near the bottom of the bottle is a white label, inside of which are the words "BAREFOOT BUBBLY", with the "BAREFOOT" capitalized and in gray, and the "BUBBLY" in small letters underneath "BAREFOOT" and intersecting with it slightly, and in rainbow colors, namely, running from red to orange to yellow to green to blue to purple to pink to gray to light blue to brown to black, through the letters. Above the word "BAREFOOT" is a stylized solid footprint in shades of gray. In the upper left and lower right areas of the label are slightly wavy stripes in the same fixed pattern of color as the neck label. Scattered around the label are gray dots representing bubbles. The shape of the bottle is not claimed a feature of the mark, and is depicted in dotted lines for the purpose of showing the position of the mark on the goods.
