PUBLICATION AND ISSUE SECTION

Mark description

The mark consists of a configuration of the packaging for the goods. The outline of the bag in broken lines and the horizontal broken lines at the top and bottom of the bag are intended to show the placement of the mark on the container and are not part of the mark. The mark consists of a rectangular shape divided into an upper green area and a lower red area, with a curved dark green line separating the two areas. The green area contains dark green silhouettes of leaves and areas of white. Within the green area, and partially extending into the red area, is the word "TORTOLINES" displayed in yellow and having black and white outlining. The letters "O" and the dot in the letter "I" are circular with black dots in the middle. The lower red area contains dark red, circular abstract designs in the top portion, along with a dark red silhouette of leaves on the right side. Below the abstract designs is a plain red, rectangular banner containing the wording "SPICY FLAVORED" above the words "PLANTAIN CHIPS", each in white lettering. Next to the wording is a cartoon design of a plantain chip smiling and giving a thumbs-up symbol with its hand. The cartoon has a yellow body and arms and has black outlining on the body, arms, legs, and feet. The face has black eyebrows, and white and black eyes. The interior of the mouth is black with white teeth and a red tongue. The cartoon has dark green pants with light green shading and yellow shoes having dark yellow shading with white shoe laces and soles. Dark yellow shading also appears on the arms and face. The cartoon is standing on a green, dark green, and light green colored leaf. To the left of the cartoon are several stacked yellow and orange plantain chips. Under the chips and leaf is a light grey background area with portions of dark grey shading. The background color white outside of the bag is not claimed as a feature of the mark.
