Mark description

The mark consist of a depiction of the bottle container for the goods, with a label and a cap. The base of the bottle begins wide then slightly narrows and then the bottle widens again, creating a tapered effect. At the neck of the bottle the term "BERTOLLI" clear in color is blown into the glass and similarly the wording "DAL 1865" clear in color is blown into the glass just above the base of the bottle. The cap is the color green, and the label has a white background color. At the top of the label is a red and gold colored crest with a gold crown and gold laurels, with the crest superimposed on a red oval with a white inner border and a gold outer border. The word "BERTOLLI" in white outlined in black and "DAL 1865" in gold appear within the oval. The words "WORLD'S NO. 1 OLIVE OIL BRAND" in black appear just above the oval and the wording "BRAND ESTABLISHED IN 1865 IN LUCCA, TUSCANY" in black appear just below the oval. A tan olive branch design with green leaves and three black olives appears further underneath the oval. There is a green double line and squiggle design above and to the right of the olives. Above the olives are the words "COLD EXTRACTED" in green. Below the olives between two double green lines with green dots are the words "EXTRA VIRGIN" in green. Below the lines is the wording "OLIVE OIL" in green inside the design of a green boat. The wording "SELECTED OLIVE OILS FROM ARGENTINA, ITALY, SPAIN AND TUNISIA" appear in green below the boat. Towards the right side of the label, the words "PIONEER EXPORTER OF OLIVE OIL TO THE USA" appear in gold in a semi-circle, along with a depiction of a sailing ship in gold directly underneath. There is a gold line between "PIONEER EXPORTER" and "OF OLIVE OIL TO THE USA". There is gold shading behind the semi-circle. Below the design of the ship is the stylized wording "BERTOLLI" in green. At the bottom right of the label within a green design with four curved sides having a gold border are the words "RICH TASTE ORGINIAL" with a gold filigree above the wording and a white dot on either side of "ORIGINAL". Below that is "500 ML (16.9 FL OZ) (1PT 0.9 OZ)" in white. The golden color of the bottle depicts the level of the oil and is not claimed as a feature of the mark.
