Mark description

The mark consists of a depiction of the bottle container for the goods, with a label and a cap. The base of the bottle begins wide then slightly narrows and then the bottle widens again, creating a tapered effect. At the neck of the bottle the term "BERTOLLI" clear in color is blown into the glass and similarly the wording "DAL 1865" clear in color is blown into the glass just above the base of the bottle. The cap is the color orange, and the label has a light green background color. At the top of the label is a red and gold colored crest with a gold crown and gold laurels, with the crest superimposed on a red oval with a white inner border and a gold outer border. The word "BERTOLLI" in white outlined in black and "DAL 1865" in gold appear within the oval. The words "WORLD'S NO. 1 OLIVE OIL BRAND" in black appear just above the oval and the wording "BRAND ESTABLISHED IN 1865 IN LUCCA, TUSCANY" in black appear just below the oval. A tan olive branch design with green leaves and three black olives appears further underneath the oval. There is a green double line and gold squiggle design above and to the right of the olives. Below the olives between two double green lines with green dots are the words "OLIVE OIL" in green. Below the lines is the wording "OVER 150 YEARS OF EXPERTISE" in green inside the design of a green boat. The wording "SELECTED OLIVE OILS FROM SPAIN AND TUNISIA." appear in green below the boat. Towards the right side of the label, the words "PIONEER EXPORTER OF OLIVE OIL TO THE USA" appear in gold in a semi-circle, along with a depiction of a sailing ship in gold directly underneath. There is a gold line between "PIONEER EXPORTER" and "OF OLIVE OIL TO THE USA." There is gold shading behind the semi-circle. Below the boat is a white banner with green lines with the word "BERTOLLI" in green inside it. The gold wording, ship and green BERTOLLI all are within a black plain line circle. At the bottom right of the label are the words "500 ML (16.9 FL OZ) (1PT 0.9 OZ)" in green. Below the label is an orange rectangular horizontal band with a light green border above and below the band. On the left side of the band is a black circle with a white outer border, and within the circle the top half appears in white with the wording "USDA" shown inside in green and the bottom half appears in green with three light green lines with the word "ORGANIC" shown in white. To the right of the circle and also inside the orange band are the words "ORGANIC," "MILD," and "SMOOTH TASTE" shown in white and gold. The golden color of the bottle depicts the level of the oil and is not claimed as a feature of the mark.
