Mark description
The mark consists of the wording "TIKIZ SHAVED ICE & ICE CREAM" in white, outlined in black. The configuration of product packaging as applied to the exterior of a service truck, including the elements contained on the front, back and both sides of the truck. The broken lines depicting the truck tires, wheels, doors, door handles, front and rear vehicle lights, grille, service window, windshield and windows, mirrors, truck cab interior, and gas cap all indicate placement of the mark on the service truck, and are not claimed as part of the mark. The product packaging consists of the following sections: (1) The driver and passenger rear side panels of the vehicle-Above the service window on both sides are yellow surf boards with a light-brown running tiki man with flaming hair. He has a large toothy smile, his eyes closed, wearing a grass skirt. With his right hand he is holding a surf board that is yellow, royal blue and white. His left hand is in a shaka symbol. The tiki man appears towards the front of the surf board on the driver's side and towards the back of the surf board on the passenger's side. Written on the surf board are the words "TIKIZ Shaved Ice & Ice Cream". The words "Shaved Ice" are above the ampersand and words "Ice Cream". The side panels of the truck picture a beach scene comprised of light green and dark green tropical greenery, pink and white hibiscus, birds of paradise flowers, and heliconia in the foreground. Behind that is a depiction of a beach with a sky-blue sky above the tan sand. On the back end of the panel is a Macaw. Framing the service windows are two palm trees with flowers draped down the trunk. In the back ground next to the cab doors are two black silhouetted birds flying towards the end of the truck. On the drivers' side panel between the door and closer to the back wheel well is the image of the tiki man. On the passenger side panel the tiki man's depiction is larger and situated closer to the passenger door. (2) The driver and passenger doors of the vehicle-Both doors have the same royal blue and white pattern as on the surfboard the tiki man is carrying which continues on to the sides of the hood. In the middle of each door is the logo. (3) The logo-The logo is comprised of the word "TIKIZ" in front of a sky-blue circle representing sky with white clouds, and two palm trees on either side of the words. Behind the characters "T" and "Z" are two lit tiki torches. Below the word "TIKIZ" are four red, orange, and purple hibiscus flowers and the words "SHAVED ICE & ICE CREAM". Above the word cream is the same depiction of the tiki man. (4) The rear panel of the vehicle-The rear panel continues the beach scene with the light blue ocean in the background with a sky that transitions from yellow to a blush to a sky-blue. At the top of the door in the middle is the logo. Three white silhouetted birds fly towards the top left corner. At the base of the truck in the foreground is more light green and dark green tropical greenery with birds of paradise flowers, pink hibiscus, heliconia, and red flamingo flowers. (5) The hood of the truck-The hood of the truck contains the same logo with the royal blue design meeting underneath from the side doors.
