Mark description

The mark consists of a three-dimensional trade dress for the interior design and layout of a hair and beauty salon. The interior features a centrally-located counter with a foot bar running along the bottom, which is open in the middle and back, resembling a restaurant-style bar. The sides of the bar contain a design of evenly-spaced horizontal boards. The word "drybar" appears in the middle of the front side of the bar. Evenly spaced mirrors hang on the walls on the left and right sides of the bar between wall sconces. The wall to the left side of the bar features built-in shelving. The wall behind the bar contains an open doorway with trim along the baseboards and the doorway. To the left of the doorway hangs a chalkboard with a frame. On the counter are decorative elements consisting of flower arrangements and vases. In the center of the bar is a tall product display unit, resembling a back liquor bar-style shelf, with recessed lights above each column of glass shelves that are hung in front of a mirrored back panel. A flat screen television is mounted in between the columns of glass shelves on the product display unit. A row of upholstered salon chairs atop metal bases runs alongside the salon bar counter. Hanging from the ceiling above the length of the salon bar is a row of large fabric-shaded cylindrical pendant light fixtures. The entry of the salon features a light fixture comprised of five hairdryers hanging upside down from their cords from a mounting plate affixed to the ceiling. Wood flooring is throughout the interior. The placement of various items as specified herein are considered to be part of the overall mark.
