Mark description

The mark consists of a three-dimensional trade dress of the exterior design and layout of a hair and beauty salon. The exterior features a clear glass storefront with two glass doors with white trim and a grey handle on each and a window on each side with white trim. A white horizontal line appears across the entire width of the front containing a series of unevenly spaced white silhouettes of various shaped bottles and on the right side door is a silhouette of a hair dryer in yellow hanging vertically by its cord in yellow. The wording "drybar" appears on the left side window with "dry" in yellow and "bar" in white. Above the storefront is a grey awning also containing the wording "drybar" with "dry" in yellow and "bar" in white. To the left of the left side door is a yellow occasional table. Visible inside the salon through the clear glass front windows is a decorative rectangular-shaped chalkboard in grey with a white frame in the right front window, the front part of the left wall contains a white tufted wall panel, a mirror appears on the back left wall and a light fixture made of connected yellow hair dryers hanging from their cords appears in the middle of the white ceiling. An upholstered slipper-style chair, long, ornate, wooden-framed benches with upholstered seat cushions, an occasional table and flowerpots are placed throughout the interior. Wood flooring is throughout the interior. The placement of various items as specified herein are considered to be part of the overall mark.
