Mark description

The mark consists of a three-dimensional configuration of a green bottle with a black wrapper surrounding the neck and cap of the bottle and two labels affixed to the body of the bottle, with the larger of the two labels appearing above the smaller label. The wording "BALLANTINE'S ESTD 1827" appears in gold on the black wrapper with two horizontal gold lines flanking either side of the wording "ESTD 1827", above the initials "GBS" embossed in green on the upper portion of bottle itself. Directly below that, the wording "BALLANTINE'S THE ORIGINAL BLENDED SCOTCH WHISKY FULLY MATURED FINEST QUALITY ESTD 1827 AGED 17 YEARS GEO BALLANTINE", as well as a coat of arms design, appear on the larger cream and white label. All of the wording on the larger label is black, except for "THE ORIGINAL" and "EST: 1827", which are in gold, and the number "17", which is in red. The coat of arms design appears in red, yellow, blue, white, brown and grey. Directly below that on the smaller cream and gold label appears the black wording "PRODUCT OF SCOTLAND", "AN EXCEPTIONALLY SMOOTH AND ELEGANT WHISKY", "BLENDED AND BOTTLED BY GEORGE BALLANTINE & SON LTD. DISTILLERS DUMBARTON SCOTLAND FINEST QUALITY FULLY MATURED 70CLE 43%VOL". At the base of the bottle, below the smaller label, the signature "GEO BALLANTINE" is embossed in green on the bottle itself. The broken or dotted lines outlining the overall shape of the bottle and bottle cap indicate placement of the mark on the goods and are not part of the mark.
