O registro de desenho industrial se refere a uma nova configuração ornamental de um objeto, independente das soluções técnicas e vatagens que esta nova configuração apresente. O objeto em questão possui a forma ornamental conhecida, conforme descrito no relatório: "o projeto se baseia na utilização do próprio letreiro luminoso dos táxis atuais", a criação está na iluminação utilizada no letreiro.Assim sendo, o objeto do pedido está em desacordo com o art.95 e está inserido no art.100: "não é registrável como desenho industrial".
